It can be respectful and amicable, where you cooperate to ensure what happens to your family and finances is best for all. Or it can be hostile, and you put everything at risk. You have a choice you might not have heard about.
What is Collaborative Divorce?
Collaborative Divorce is an Alternative Dispute Resolution process that strives to preserve the emotional and financial resources of the family while achieving an agreement that considers and respects the welfare of everyone in the family.
The Collaborative Divorce model provides divorcing parties the opportunity to problem solve in a private, confidential setting, with the help of their experts, to reach a creative settlement that meets the needs of their family.
In the Collaborative Divorce process, the divorcing couple sign a legal stipulation agreeing they will not go to court to resolve their differences. The couple works with a Collaborative Divorce team which helps and guides them through their divorce. Each party is represented by a collaboratively trained family law attorney, a licensed and collaboratively trained mental health professional who functions as a divorce coach, a financial specialist, and, if there are children, a child specialist. The number of collaboratively trained professionals included on a team depends on the level of cooperation between the parties, their willingness and ability to commit to a healthy divorce, and the complexity (emotional and financial) of the case.
The Center for Couples Therapy has two Divorce Coaches, Trish Stanley, PsyD, LMFT, and Ryan Jones, LCSW. They can explain the differences between a litigated divorce, a mediated divorce, and the Collaborative Divorce process. Either of them can be a point of entry for you in the Collaborative Divorce process. They can connect you with a Collaborative attorney, assist in building a team that will support you in developing a vision for your post divorce life, and help you make the steps that will take you there.
